PRIVACY POLICY

EFFECTIVE SEPTEMBER 10, 2022

Machine Research Corporation (“MRC”) understands that an original equipment manufacturer’s designs, products, and manufacturing processes contain sensitive information, are proprietary in nature, and require appropriate safeguards to prevent improper disclosure.

 

MRC is committed to protecting our Customer’s privacy and Confidential Information. MRC does not collect information from its Site visitors, Customers or any of their Authorized Users that we do not need and MRC does not share this information with anyone except for protecting our rights, to comply with applicable law, and to develop, improve and continue our products or services.

 

This policy describes the types of information we may collect from you or that you may provide when you visit the website machineresearch.com, including any data or information collected and used by MRC in connection with its Customer’s use of any services (“Services”) or materials (“Materials”) available or enabled via the machineresearch.com website (collectively with the Services and Materials, the “Site”) and our practices for collecting, using, maintaining, protecting, and disclosing that information.

 

This policy applies to information we collect:

  • On this Site.

  •  In email, text, and other electronic messages between you and this Site.

  • It does not apply to information collected by:

  • Us offline or through any other means, including on any other website operated by MRC or any third party (including our affiliates and subsidiaries); or

  • Any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or through the Site.

 

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our Site. By accessing or using this Site, you agree to this privacy policy. This policy may change from time to time. Your continued use of this Website after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

 

CHANGES TO THE PRIVACY POLICY

 

Any registration or other information that identifies or can be used to identify the Customer to whom such information pertains (“Customer Information”) that we collect and maintain will be subject to this Privacy Policy. MRC may change this Privacy Policy from time to time in its sole discretion and will provide notice of changes in the Privacy Policy and on the Site’s home page. The date the privacy policy was last revised is identified at the top of the page. If Customer has objections to the Privacy Policy, it should immediately discontinue use of the Site.  Unless at the time a Customer provides Customer Information to MRC the Customer expressly limits how such information will be used to communicate with the Customer, either by MRC or third parties, MRC will not change any of Customer’s preferences in this regard without the Customer’s consent, and the Customer will be deemed to have been made aware of, and will be subject to the changes to, the Privacy Policy after MRC has posted the notice of changes in the Privacy Policy and on the Site’s home page.

 

Children Under the Age of 18

Our Site is not intended for children under 18 years of age. No one under age 18 may provide any information to or on the Site. We do not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information on this Site or through any of its features, register on the Site, make any purchases through the Site, use any of the interactive or public comment features of this Site, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a person under 18, we will delete that information. If you believe we might have any information from or about a person under 18, please contact us at support@machineresearch.com.

 

CUSTOMER INFORMATION AND PREFERENCES

 

Customer has the right at all times to access and correct its Customer Information and privacy preferences, if any.  Any information may be edited or corrected by Customer by linking to its account at the “Login” link on the Site, or Customer can edit and correct Customer Information and privacy preferences, if any, by writing to MRC at:

MRC is committed to respecting Customer preferences and legal rights with respect to access to, correction of, and deletion of Customer Information.  Except in particular circumstances described in this Privacy Policy, or where required by applicable law, regulation, litigation, national security, or law enforcement, MRC will not provide Customer’s Information to other companies or organizations without Customer’s consent.

 

If a Customer provides MRC with inconsistent preferences (e.g. indicating on one occasion that Customer may be contacted with respect to marketing offers from MRC or third parties and on another that Customer may not be contacted with respect to such offers) MRC will update its records with Customer’s latest preference in a timely and accurate manner.

 

MRC is not responsible for the content or privacy practices of any non-MRC websites to which this Site may link. Customers are strongly advised to review the privacy policy of any of these websites before using them.

 

 

COLLECTION OF CUSTOMER INFORMATION

 

As our Customers access and use the Site, MRC may from time to time ask Customer to provide certain information and data about Customer or its Authorized Users by filling out and submitting a form or a field on the Site.  This information could include, for example, Customer’s first and last name, mailing address, country of residence, e-mail address, telephone or facsimile number, work address, and other information.  Of course, it is optional for Customer to provide such information, however, in some instances MRC may require certain mandatory information about Customer in order for Customer to gain access to or use the Site. If Customer does not provide mandatory data and information with respect to that particular access to or use of the Site, Customer will not be able to access or use the Site. Or, if Customer wishes to delete Customer’s data and information (as provided in the CUSTOMER INFORMATION section above) and such data or information is mandatory, then Customer may no longer be able to access or use the Site.

 

In order to facilitate our evaluation of Customer’s use of the Site, the Services and the Materials, MRC will also from time to time collect information about Customer’s computer which may include among other information, its operating system, CPU speed, Internet Protocol (IP) address, referring or exit web pages, and browser type.  MRC will use this information to measure Customer’s use of the Site, the Services and Materials to support, evaluate, enhance, or improve and supplement Customer’s user experience with the Site, and may use the same to improve the Site.

 

In addition, MRC may choose to supplement any Customer Information provided to us with information about them available from other third party sources.  Where permitted by law, we may, for example, supplement Customer’s Registration Information with address information provided by the U.S. Post Office to maintain and improve performance of our databases, authenticate users, or prevent abuse of the Site.

 

In some instances, MRC may choose to link from the Site to various third party vendors and service providers who may have products or services that our Site users might find useful, such as those that can be used with or are compatible with the Services and Materials accessible from or enabled by the Site.  In order to use any products or services from such third parties, Customer may be required to provide Customer Information to such third parties.  In such event, any Customer Information that is provided to these third parties will be subject to the privacy policy posted on their web site, and will not be governed by this policy..

 

Cookies, web beacons and similar tracking devices:

MRC may use cookies, web beacons or other devices to track Customer’s use of the Site (e.g. types of Services or Materials used, number of uses or downloads, number of users of the Site) and web servers will automatically log the IP/Internet address of Customer’s computer, browser type and language, referring/exit pages and URLS, other browser history, platform type number of clicks, landing pages, pages requested and viewed, amount of time spent on pages and the date and time of pages viewed.  Except as provided below with respect to Fraud Protection (defined below), this information is collected in aggregate form, that is, as a statistical measure, solely for MRC’s uses for internal business purposes and statistical analysis, for improving and enhancing the Site, and to develop new MRC products and services, but only in a manner that would not disclose to any third party our Customer’s Confidential Information.

 

For Customer’s information and understanding, a cookie is a small amount of data that is transferred to the Customer’s browser by a web server and can only be read by the server that transferred it to the Customer.  It serves as the Customer’s ID card and enables the web server that gave it to the Customer to record Customer’s passwords and preferences.  A web beacon is a small gif image that is embedded in an HTML page or email used to track when the page or email has been viewed.   Similar devices can be embedded in the Services or Materials to send data to a web server when a set of user-initiated events occur, as when a user clicks on one or more buttons to initiate an action, direction or response on the Site.

 

Most browsers default to allow or accept cookies, and most products and services that include similar devices also default to activate or allow the collection of data.  Customer can typically set their browser to notify them when they receive a cookie, giving them the option to decide whether or not to accept it (however, some web pages, including those that may be contained in web sites linked to this Site, may require an authorization and may not grant them the option of choosing not to accept cookies or similar devices and will likely not allow them to access those pages or any related products or services).

 

In addition, as part of MRC’s efforts to combat fraud (“Fraud Prevention”), we record our Customers’ IP addresses when they use the Services, and we confirm that the geographic location associated with Customer’s IP address matches the billing address information provided to us with any Registration Information.  This process may allow MRC to detect and prevent certain fraudulent transactions from being processed through the Services.

 

Billing Information:

If a Customer purchases a paid subscription to our Services and at any time pays for the subscription with a credit card, this information is securely passed on to our payment processing partner and is not stored at or by MRC.

 

USE OF CUSTOMER INFORMATION

 

MRC collects Customer Information to support, record, facilitate and enhance the Site and to personalize Customer’s experience.  When our Customers register to use the Site, the information is logged to register Customer’s rights to tech support and other benefits made available from time to time to registered users.  Except where prohibited by law or where a Customer has opted to not receive such communications, we also use Customer Information to track Customer’s use and their preferences, if any, and to keep the Customer informed about product and service upgrades, and other products and services of MRC, its partner vendors and partner service providers and other third parties. MRC does not sell, trade, or otherwise transfer to outside parties Customer Information or any Customer Confidential Information. MRC may use Customer Information that is collected in aggregate form, that is, as a statistical measure, for MRC’s uses for internal business purposes and statistical analysis and for improving and enhancing its Site and to develop new MRC products and services, but only in a manner that would not disclose to any third party our Customers’ Confidential Information. MRC may also release Customer Information when we believe release is appropriate to comply with applicable law, enforce our Site policies, or protect ours or other’s rights, property or safety.  With respect to any proprietary design, product, and manufacturing data and other materials the Customer generates when it uses the Services, we may from time to time analyze this data for MRC’s uses for internal business purposes and statistical analysis and for improving and enhancing the Site and to develop new MRC products and services, or targeting offers to our Customers but only in a manner that would not disclose to any third party or any other prospect our Customers’ Confidential Information. MRC may also use this proprietary design, product, and manufacturing data and other materials where the purpose of such use within MRC is reasonably required in furtherance of or a part of (i) providing, maintaining, securing or modifying MRC’s Service regarding such data, (ii) automated tools intended to address or prevent a service, support, or technical issue, (iii) Customer’s request or with Customer’s consent given to MRC’s technical support team or other personnel as part of addressing or preventing a service, support, or technical issue, or (iv) MRC’s legal obligations or proceedings described further in MRC’s Terms of Service.

 

PROTECTION OF CUSTOMER INFORMATION

 

MRC classifies the Customer Information that our Customers submit and provide in connection with registering as a user of the Site as “Registration Information”.  Customer’s Registration Information is protected in the following ways:

  • Access by Customer to Customer’s Registration Information is available only through a password and unique user identifier select by the Customer, and the password is encrypted.  (MRC strongly advises that our Customers not share Customer’s password or unique customer ID to anyone.)

  • Customer’s Registration Information resides on secure servers that only selected MRC personnel and contractors have access to via password.  These personnel and contractors are bound under strict confidentiality agreements with MRC prohibiting disclosure or use of Customer’s Registration Information other than for its intended purposes as contemplated by this Privacy Policy.

 

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information as it is transmitted to our Website. Any transmission of personal information is at your own risk.
 

TRANSFERS OF INFORMATION TO SUCCESSORS AND ASSIGNS

 

Customer acknowledges and agrees that if MRC sells or assigns assets (or the assets of any division or subsidiary) to another entity, or MRC (or a division or subsidiary) is acquired by or merged with another entity, MRC may provide to such entity Customer Information that is related to that part of our business that was sold to, assigned to, or merged with the other entity without obtaining Customer’s further consent, but MRC will provide notice of such asset sales, assignments, acquisitions, or mergers on the Site.

 

Your State SPECIFIC Privacy Rights

 

If you are a California, Nevada, Colorado, Virginia, or Utah resident, your state's laws may provide you with additional rights regarding our use of your personal information.

Nevada residents have the right to opt-out of the sale of the personal information under Nevada Revised Statutes Chapter 603A. However, please know we DO NOT sell data triggering that statute's opt-out requirements.

California's "Shine the Light" law (Civil Code Section § 1798.83) permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. However, please know we DO NOT disclose personal information to third parties for their direct marketing purposes.

Colorado, Virginia, and Utah each provide their state residents with rights to:

  • Confirm whether we process their personal information.

  • Access and delete certain personal information.

  • Data portability.

  • Opt-out of personal data processing for targeted advertising and sales.

  • Colorado and Virginia also provide their state residents with rights to:

  • Correct inaccuracies in their personal information, taking into account the information's nature processing purpose.

  • Opt-out of profiling in furtherance of decisions that produce legal or similarly significant effects.
